-Please respect check-in and checkout times. Check-in: 4pm. Checkout: 10am. -This is a private property and the Host reserves the right to access the property at any time to perform maintenance repairs necessary or requested by the renter. -Please be respectful to the neighbors and keep noise levels low, especially between the hours of 9pm-8am. -Please no food or drinks in any of the rooms, especially on the carpet or furniture. -This is a family home, NO partying is permitted. No exceptions. -Upon checkout, please be sure to clean your dishes and/or load and start the dishwasher, throw out all of the garbage, turn off all unused appliances, and turn off all lights.
EARLY CHECK-IN/LATE CHECK-OUT: -24+ hour notice of early check-in @ 1 pm - $200 -Within 24 hour notice of early check-in @ 1 pm - $250 -24+ hour notice of late check-out @ 12pm - $200 -Within 24 hour notice of late check-out @ 12pm - $250 -Guests remaining on the premises past check-out time without notifying the host will be charged an additional $500 fine.
HOUSE THERMOSTAT: -The house is normally set at a temperature of 72 degrees, guests may request this to be adjusted during their stay as it is controlled remotely by the host.
FIRE PIT USE: - Guests must request use of this feature prior to their stay. - Hours of use for the fire pit are strictly from 6pm to 9pm. Failure to comply with these hours will result in a $500 fine and an additional $100 per hour fine. -The fire pit requires a key to turn on. Guests assume all responsibility using this amenity. IMPORTANT: Unattended fire will result in a $500 fine and an additional $100 per hour fine should the fire be left on.
POOL AND SPA WATER FEATURES USE: -Please make sure spa is off after use. And cover is put back on.
POOL HEATING: If desired, the use of additional pool heating features can be requested for an additional $250 per day for 8 hours max per day. The host does not guarantee a specified heat as the weather can sometimes determine how fast the pool can heat up completely.
POOL, SPA SAFETY: -Do NOT leave children unsupervised in or around the pool. -It is not recommended to allow children in the Spa. -Guests use the Pool, Spa at their own risk. -Do NOT climb on or jump off the deck. Failure to comply with this rule may result in cancelation of the reservation with no refund to the Guest. -By booking this property, the Guest asserts that they have read and agree to the conditions regarding the risk of these amenities.
SMOKING: A $1000 fine will be charged to Occupant if there is any evidence of smoking inside or outside of the property within a 20’ radius of the property.
Please note that by completing a reservation for this home, you agree to the following:
Condition of Premises. As the Guest and those on the guest list who are visiting and/or staying in the home (you and each of them each a "Guest") accepts the Premises “as is.”
Indemnification. Guest shall release, indemnify, defend, and save harmless the Host and to the extent allowed by law, you agree to waive any claims or lawsuits and will not hold us responsible for injuries or damages related to your use of the premises.
This Short Term Rental Agreement is between the Property Owner ("Homeowner" or "Host") and you as the Guest (or “Occupant”) of the date set forth on the reservation details confirmation noted on the confirmation which shall be received by both Parties via email as well as provided in the Vrbo software. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
FIRE AND FIRE SAFETY: Occupant is notified that the Property may be located in an area susceptible to fire, and as such Occupant agrees all conform with all applicable fire codes of any governmental authority, and ensure safe and reasonable use, management, and extinguishment of any fire places, bbq's, fire pits and any other device or act involving the risk of fire. In the event Occupant discovers any fire related safety issues, Occupant shall immediately inform the Host and cease and desist immediately from undertaking, or continuing usage until inspection, remediation (if necessary) and written approval by the Host that use is permitted. Flammable substances and solids, such as gasoline, benzene, naphtha, cleaning fluids, explosives, and fireworks may not be used or stored on the Property. ALL COOKING MUST BE CONFINED TO DESIGNATED COOKING AREAS.
EVENTS, GATHERINGS, PARTIES: No events, hosting special occasions, including but not limited to weddings, corporate functions, bridal parties or related events including inviting other persons not disclosed in the reservation guest count, shall be permitted on the property without prior written consent from the Host. Failure to comply will result in a $5000 fine and immediate removal of Guests from the property with NO REFUND.
CLEANING, PESTS, AND INCONVENIENCES: Occupant acknowledges and agrees that renting a home comes with certain risks that the Host cannot prevent and as such will not result in any refunds or credits to Occupant shall they be discovered, viewed, endured or otherwise reported. Such examples include but are not limited to seeing pests, outside of the home, or minor cleaning complaints, which when feasible Manager will make a good faith effort to remediate, shall Occupant approve of the same during their stay. Any cleaning complaint shall be deemed minor except for any instance in which no cleaning took place prior to the guest arrival, the time and date of which is outlined in the confirmation of booking details.
VISIBLE HAZARDS: POOL, SPA USE: Occupant, on behalf of Occupant and all other occupants and guests of Occupant during the Term, acknowledges they are renting a residential home that includes a swimming pool, water spa, and other amenities. Occupant further acknowledges that they have INTENTIONALLY ELECTED to rent this home that includes the POOL, SPA, AND AMENITIES. Additional Acknowledgments:
1. The inherent risk of drowning associated with immersion in water. 2. The inherent risk of falling injury/subsequent drowning associated with the slide, waterfall, or any hard surfaces surrounding the pool and spa which may become slick because of water on those surfaces, a risk particularly enhanced by horseplay and careless behavior. UNSUPERVISED CHILDREN are particularly susceptible to the dangers inherent in the use of the pool and spa amenities. DO NOT leave children unsupervised. 3. The inherent risk of drowning is enhanced by the USE OF ALCOHOL, and such use is not recommended before or during the use of the pool and spa amenities. The effects of alcohol may be enhanced by dehydration and heat. 4. The spa and/or sauna may be set higher than 98 degrees, and prolonged immersion in such temperatures can result in overheating of the body and subsequent medical complications, including death. 5. Spa heat can also result in unintentional loss of consciousness or falling asleep, which can result in overheating/drowning/death. This danger is accentuated by the use of alcohol. Occupant(s) acknowledge that the Homeowner provides NO SUPERVISION or other protection against the inherent risks associated with pool, spa use, whether by Occupant, their children or their guests, and Occupant accepts full responsibility for the increased level of care and potential injury associated with these amenities. Occupant further acknowledges that DIVING IS PROHIBITED because neither is of sufficient depth or design to accommodate diving. Diving will likely result in INJURY or DEATH. 6. Improper use of the slide, waterfall, or any features included with the pool, spa can result in INJURY or DEATH.
PERSONAL PROPERTY AND INJURY: The Homeowners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. Neither the Homeowners nor the Homeowner's Association are responsible for the loss of personal belongings or valuables of the Guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
INSURANCE: Occupant's or guests' personal property, including vehicles are not insured by the Homeowner against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others or any other cause. The Homeowner, does not insure against personal injury to Occupant, occupants, guests, or licensees, due to any cause or reason.
INDEMNITY AND HOLD HARMLESS: Occupant and any guests, invitee or licensee of occupant, for himself/herself, his/her heirs, assignors, executors and administrators, fully releases and discharges the Homeowner from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage, theft or injury to Occupant, invitees or licensees of Occupant, or their personal property, arising out of or in connection with Occupant’s use and occupancy of the Premises, including the Pool and/or Water Spa, which is made, incurred or sustained by Occupant, other occupants, guests or licensees of Occupant. ADDITIONAL GUESTS: This home is set up to comfortably host a total of 9 guests at no additional charge. Any additional guests including children will be charged an additional fee per night (including children 1 years of age and older). All additional guests need to be approved before visiting the property. This additional fee helps to cover the costs of additional cleaning & additional linens as well as additional wear and tear on the home.
